All calls to customer support services will be charged at the standard rate charged by your telephone operator, and calls (both incoming and outgoing) may be recorded for the purpose of monitoring the quality of our services and improving Baza Ghilgal products and/or services.

The Baza Ghilgal Foundation reserves the right to change, correct, modify, add, and/or withdraw the terms and conditions in whole or in part. Therefore, please consult the provisions of this document regularly. In any case, the updated version of the terms and conditions can be read at any time by using the “Terms and Conditions” link at the bottom of the Website pages.

If you do not agree to comply with these terms and conditions, please do not use this site. Also, if at any time the terms and conditions set forth in this document become unacceptable to you, please immediately discontinue accessing and using bazaghilgal.org/

1.1.        Definitions 

1.1.1.    bazaghilgal.org/en, the Company or the Seller refers to Baza Ghilgal Foundation, a Romanian legal entity with its registered office in ORADEA  Bihor, STR. PRIMĂVERII, NO. 8, registered with the Trade Register under no. 48303939

1.1.2.    The Website, Platform, or bazaghilgal.org/en refers to the domain bazaghilgal.org/en and/or its dedicated subdomains;

1.1.3.    Visitor  means any person who visits the Website or our social media pages, having the possibility to browse bazaghilgal.org/en, place Orders, communicate with us via Chat, social media or otherwise;

1.1.4.    User refers to any Visitor who has completed the process of registering an Account on bazaghilgal.org/en;

1.1.5.    Products and/or Services means any product or service to be provided by the Ghilgal Base Foundation as a result of the Contract concluded between the Seller and the Buyer.

1.1.6.    Client or Buyer  refers to the Visitor or User who places an order on the Website to benefit from the Products and/or Services of the Ghilgal Foundation, in exchange for the price associated with those Products and/or the Ghilgal Foundation;

1.1.7.    Order refers to an electronic document between the Ghilgal Base Foundation and the Buyer through which the latter expresses their intention to purchase Products and/or Services provided by the Seller and to proceed with their payment.

1.1.8.    User Account or Account refers to the section of the Site consisting of an email address and password containing information about the Customer and/or order history, preferences, etc.

1.1.9.    Contract refers to the form of remote electronic communication between the Parties, through which the Seller validates the Customer’s order and expresses its agreement regarding the sale/delivery of the Product and/or the provision of the Service.

1.1.10. Digital content refers to all information of any kind and all files available on the Site, or displayed by bazaghilgal.org/ on our social media pages (such as photos, illustrations, text files, video and/or audio files, animations, flash files, data files, and other materials, including but not limited to images, text, symbols, web graphics, scripts, programs, etc.) that can be visited, viewed, or otherwise accessed through an electronic terminal;

1.1.11.  Comments or Feedback  refers to any appreciation, criticism, or observation provided by the Visitor or User as a result of browsing the Site and/or as a result of purchasing Goods and/or Services, regardless of whether they are displayed on the Site or on the FUNDAȚIA BAZA GHILGAL pages available on social networks;

1.1.12.  Document refers to the Terms and Conditions bazaghilgal.org/;

1.1.13.  GDPR refers to Regulation (EU) 2016/679 of 27 April 2016 of the European Parliament  and the Council of the European Union on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC;

1.1.14.  Specific data protection legislation refers to national and European data protection legislation, including but not limited to the GDPR;

1.1.15.  Data controller means the natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. For the purposes of this Document, this term shall refer to bazaghilgal.org/;

1.1.16.  Partner means the natural/legal person who supplies Products and/or provides Services to the Seller;

1.1.17.  Newsletter refers to the exclusively electronic newsletter sent by the Company regarding news related to the activity of bazaghilgal.org/, information about Products and/or Services bazaghilgal.org/ and/or promotions carried out by the Seller during a certain period, without any commitment on our part with regard to the information contained therein.

 

1.2.        Interpretation

1.2.1.    In interpreting this Document:

1.2.2.    Words in the singular also include the plural and vice versa;

1.2.3.    References to a person include its authorized successors and assignees;

1.2.4.    The headings in this Document are for guidance only and shall not affect the meaning or interpretation of the Document;

1.2.5.    The preamble and introductory section of this Document form an integral part thereof;

1.2.6.    The section Data Protection forms an integral part of this Document; Furthermore, all other notices, policies, sections, or other terms already displayed on the Site form an integral part of the Terms and Conditions bazaghilgal.org.

1.2.7.    In interpreting this Document, one gender includes the other;

1.2.8.    “Including” and similar expressions are not meant to be restrictive but illustrative;

2.1.   & nbsp;    Access provided by bazaghilgal.org/en to this Site is strictly for visiting, using, logging in, placing orders, tracking them, and/or sending us Feedback.

2.2.        Users/Visitors bazaghilgal.org/en assume full responsibility for accessing and using this Site.

2.3.        It is prohibited to use the Site for commercial purposes and/or in a manner contrary to the interests of the Company, without the prior written consent of FUNDAȚIA BAZA GHILGAL.

2.4.        Users or Visitors to the Site may display, upload, publish Comments and review the Products and/or Services offered by bazaghilgal. org, may send suggestions and/or questions and any other communications regarding the Products and/or Services only if they use civilized, appropriate language, and the content of the communications is not illegal, defamatory, does not contain viruses, and does not in any way violate the rights/interests of other persons. bazaghilgal.org reserves the right not to respond to and/or to delete any Comments, reviews, or communications that do not comply with the above requirements.

 

3. INTELLECTUAL PROPERTY RIGHTS

3.1.  The digital content as well as the domain and subdomains of this Site are protected by copyright or other intellectual/industrial property rights belonging to bazaghilgal.org and/or its collaborators or other third parties.

3.2.        It is strictly prohibited to download, modify, publish, transmit, transfer, or sell, reproduce, create derivative works from or in connection with the Digital Content to which you have access, distribute, display/reverse engineer/alter, or exploit it in any other manner, in whole or in part, without the prior written consent of FUNDAȚIA BAZA GHILGAL. 4. MINORS

4.1.        To register an Account bazaghilgal.org/ and/or to place Orders, you must be at least 18 years of age.

 

5. ACCOUNT bazaghilgal.org

5.1.        Open Account

5.1.1.    The Platform service called “My Account” (in short, “the Service”) is provided by bazaghilgal.org/  free of charge for your strictly personal use, subject to and in accordance with the Terms and Conditions.

5.1.2.    As a Visitor, you have the right, but under no circumstances the obligation, to create an Account bazaghilgal.org/ by filling in the dedicated form.

5.1.3.    If you do not wish to register as a User of FUNDAȚIA BAZA GHILGAL, you can still browse and place orders on the Website.

5.1.4.    In all cases, you agree and undertake not to use the Platform and/or the Service/Digital Content for any purpose other than those regulated by this Document.

 

5.2.        Access data

5.2.1.    Your account access/login details must remain strictly confidential and must not be shared or disclosed to any other person.

5.2.2.    If you know or suspect that someone else knows your Account registration details, you must notify us immediately.

5.2.3.    If you forget your password, please use the dedicated reminder service (this option can be found next to the registration box in My Account under the heading “Forgot your password?”).

 

5.3.        Activity carried out through the Account

5.3.1.    By accessing your Account and using your personal password, you are responsible for all actions that result from their use.

5.3.2.    bazaghilgal.org/ cannot be held responsible for errors arising from the User’s negligence regarding the security and confidentiality of their Account and password.

5.3.3.    If bazaghilgal.org/  has reason to believe that there may be a breach of security or misuse of the Service or Platform through your Account, we may ask you to change your password or, as appropriate, suspend your use of the Service.

 

5.4.        Limitations

5.4.1.& nbsp;   We reserve the right to refuse registration or delete the User Account if we find or have reasonable grounds to believe that the User has used information that is not true or is using bazaghilgal.org/  in violation of the Terms and Conditions.

5.4.2.    Your access to the Site and Service bazaghilgal.org/ may occasionally be limited to allow for routine maintenance.

5.4.3.    Although we take all reasonable measures and precautions in relation to your Account, we do not offer any guarantee (explicit or implicit) of any kind regarding its content or functioning. For example, we do not guarantee that the use of the Service will be uninterrupted or error-free. Therefore, you understand that bazaghilgal.org/ is exempt from any such liability, claim, or damage arising from or in connection with your use of the Service.

 

6. STATEMENTS AND WARRANTIES

6.1.        As a Visitor/User/Customer, you guarantee that:

1. a)    When interacting with Baza Ghilgal, always act in good faith and provide us with accurate, complete, and compliant information;
2. b)    Promptly update your registration/order data or other information you provide to Ghilgal Base to keep it accurate, current, and complete; Updates can be made at any time by accessing the Account Information section of My Account. This will help us ensure that the Service we provide is accurate, compliant, and current.
3. c) & nbsp;  When you provide us with information about third parties (such as, for example, information about the recipient of a floral arrangement), you always act in good faith, based on the consent provided or reasonably presumed by the person concerned, and you have no reason to believe that the provision/ communication of the data to the recipient/third party or the delivery of Baza Ghilgal Products and/or Services would be likely to cause any inconvenience to the data subject or significantly affect their legitimate rights and/or interests.

6.2.        The use of the Service is intended to facilitate your purchases made through the Platform.

6.3.        The Service and, in general, the Platform, must not be used for the following purposes:

1. a)    Publishing, distributing, disseminating, posting, or transmitting messages, materials, Comments, or information that is unlawful, illegal, harassing, defamatory, abusive, threatening, vulgar, obscene, or otherwise harmful;
2. b)    Harassment, defamation, disruption, threats, or any other violation of the legitimate rights of others, including data protection rights;
3. c)    Gaining unauthorized access to other computer systems;
4. d)    Interfering with the use of the Site by any other Visitor/User/Customer;
5. e)    Attempting to modify/alter/affect the Digital Content in any way;
6. f)   & nbsp; Uploading, publishing, or transferring in any way files that contain viruses, spyware, malware, corrupted files, or any other similar software or programs that may damage or limit/affect the functionality of the Platform, the Baza Ghilgal Service, or the Digital Content;
7. g)    Using any communication or any Digital Content or information obtained through the Platform in a manner that conflicts with the legitimate interests of Baza Ghilgal or with our activity or that of our affiliates/partners;
8. h)    In a manner that could damage, disable, overburden, or impair the Ghilgal Database in any manner or interfere with any other party’s use and enjoyment of the Site;
9. i)     Attempting to gain unauthorized access to any other Ghilgal Base accounts, computer systems, or associated networks bazaghilgal.org/;
10. j)     Attempting to obtain materials or information through any means not intentionally made available or expressly provided for by the Ghilgal Base.

6.4.        ANY ATTEMPT TO ACCESS THE PERSONAL DATA OF ANOTHER USER OR TO MODIFY THE CONTENT OF THE WEBSITE OR AFFECT THE PERFORMANCE OF THE SERVER ON WHICH THE SITE RUNS WILL BE CONSIDERED AN ATTEMPT TO DEFRAUD THE SITE AND WILL TRIGGER THE NECESSARY LEGAL ACTION AGAINST THE PERSON OR PERSONS WHO (U) ATTEMPTED THIS ACT.

 

7. CONFIDENTIALITY AND SECURITY

7.1.        bazaghilgal.org/ is a registered personal data operator. Registration number with the National Supervisory Authority for Personal Data Processing: ……..

7.2.        By visiting and using the Platform, you provide us with information that can be attributed to you to a certain extent.

7.3.        You agree and understand that your data is used in accordance with the Data Policy section available on the Site. 

7.4.        If you provide information about other people (e.g., home address), you hereby expressly confirm that you have the consent of these persons to provide us with the data necessary for the delivery of the Products and/or Services bazaghilgal.org/.

7.5.        In any case, bazaghilgal.org/  undertakes to respect your rights under specific data protection legislation, including, but not limited to, the provisions of the GDPR, and, at your request sent to contact@bazaghilgal.org  undertakes to rectify, update, block, delete or transform into anonymous data, free of charge, any data whose processing is not compliant and/or to cease/limit the processing of your personal data.

8. PRODUCTS

8.1.        bazaghilgal.org uses suggestive descriptions for the Products and/or Services sold on the Site. However, please note that the photos available on this Site are for informational purposes only.

8.2.        In certain specific situations, the shades of the products delivered may differ from those presented on the Site, depending on availability.

8.3.        Also, the size, shape, and color of the products delivered may differ slightly from the size, shape, and color of the plants available on the Site.

8.4.        If the Products available on the Site are not relevant to you, you can request a personalized offer from us.

8.5.        If certain Products are out of stock, we will notify you of any changes.

8. 6.        If we are unable to supply all or part of your order, we will notify you as soon as possible, informing you of the possibility of obtaining a partial or full refund of your order, as applicable.

9. SERVICES

9.1.        The FUNDAȚIA BAZA GHILGAL stores/warehouses offer commercial services for the sale of promotional products, as well as:

1. a)    Digital products
2. b)    Services

 

10. PRICES

10.1.      All prices for Products and/or Services displayed by bazaghilgal.org/ are expressed in Lei and include VAT.

10.2.      Delivery charges are added to the prices displayed, which may vary depending on the city and/or country where the delivery is made.

10.3.      The final price paid by the Customer consists of the price of the Product and the related shipping and/or collection costs.

10.4.      There are no so-called hidden fees on the website bazaghilgal.org/.

10.5.      The final purchase price is the one confirmed on the Order Completion page; it will appear in the order confirmation and/or on the invoice.

10.6.      In the event of a discrepancy between the initial price displayed and the price in the “Checkout” section, the Customer shall pay the price indicated in the “Checkout” section.

10.7. & nbsp;    The minimum value of an Order is 25 RON, based on the contractual conditions agreed with our partners, as well as the minimum costs required for processing orders bazaghilgal.org/.

10.8.      The seller reserves the right to change the prices displayed on bazaghilgal.org/ at any time without prior notice. This is because the purchase price of plants and/or support services may vary (for example, during peak periods, public holidays, and specific days in other countries, when the purchase price of Products and/or Services increases).

10.9.      If the Customer cannot be contacted or refuses to purchase the Product, bazaghilgal.org/  has the right to cancel the order, refunding the full amount paid in advance, where applicable.

 

11. ORDERS

11.1.      When placing an order, the Customer bazaghilgal.org/ must specify the price, payment method, and necessary delivery details.

11.2.      The contract between bazaghilgal.org/ and the Customer is considered concluded at the moment the Order is validated by the Seller, by sending the confirmation email regarding the completion of the order. The Order is validated after the Buyer credits the Seller’s account.

11.3.      By completing the Order, the Customer guarantees that: (i) they are at least 18 years of age and (ii) the information they have provided is true, complete, and accurate, bazaghilgal.org/ shall not be liable for any damage arising from or in connection with the provision of false, incorrect, or incomplete data or data used by the Customer without the permission of the recipient.

12. PAYMENTS

12.1.      Payment for Products and/or Services bazaghilgal.orgn can be made online, by credit or debit card, through the payment processor Euplatesc.ro, by bank transfer (payment order), and online postal order.

12.2.      If payment is made online, by debit or credit card, you must complete a form with your card details.

12.3.      bazaghilgal.org/ accepts the following credit/debit cards: Visa, Visa Electron, Mastercard/Eurocard, Maestro, including virtual Visa or MasterCard cards. When using a credit/debit card as your payment method, your order will be processed immediately.

12.4.      If the card transaction was successful, the next screen will provide you with relevant information about your order.

 

13. DELIVERY

 13.1.    General

13.1.1.  Before placing an order, please consult the delivery terms and prices displayed.

13.1.2.  Orders placed on the website bazaghilgal.org/ are delivered as follows:

– directly from our headquarters located in ORADEA, Bihor, STR. PRIMĂVERII, NO. 8, Bihor County, Monday through Friday between 9:00 a.m. and 6:00 p.m.;

– by courier (Fan Courier) within 24-72 hours from the moment the order is registered, except for public holidays, busy periods, Black Friday, etc.;

– through shipping companies within 3-10 business days from the date of order;

– by transport with our own vehicles belonging to bazaghilgal.org within 1-7 working days, depending on the distance, the quantity of the order, the time of year, etc.;

– FUNDAȚIA BAZA GHILGAL delivers products throughout Romania.

 

13.1.3. To avoid problems or any delays in delivery, please ensure that you have included all the relevant details of your home address and telephone number.  

 

13.2.    Limitations

13.2.1.  Please note that the carrier will deliver the goods to the address provided by you in good faith.

13.2.2.  FUNDAȚIA BAZA GHILGAL assumes no responsibility in the event that the recipient of the order is not at the address or refuses to accept the order or confirm delivery.

13.2.3.  In the event that the recipient of the order is not at the address and the carrier cannot ask another person to accept the delivery on behalf of the recipient (such as a neighbor), the sender will be notified and delivery will be attempted again at a later date.

13.3.    Impossibility of delivery

13.3.1.  In exceptional cases, it may not be possible to deliver at the date and time you have chosen. In such circumstances, we will contact you without delay to make alternative delivery arrangements or, if you prefer, to give you the opportunity to cancel your order.

13.3.2.  We cannot be held liable for failure to fulfill our obligations if the impossibility of delivery is the result of unforeseeable and unavoidable events (such as fires, floods, earthquakes, storms, or other natural disasters, war, invasion, strikes, blockages, or interruptions/insufficiency of electricity, telephone service, etc.).

13.4.3.  The Customer shall be informed without undue delay if, for reasons not attributable to the Seller, delivery is not possible to the location indicated in the Order. In this case, the order shall be considered canceled and the amount paid by the Customer shall be refunded in full.

 

13.4.4.  The Customer shall be informed without undue delay if the delivery of the Product and/or Service cannot be made due to the Seller’s sole fault. In this case, the amount paid by the Customer shall be refunded within a maximum of 14 days from the date of the above-mentioned notification.

14. 14. WITHDRAWALS AND CANCELLATIONS

14.1.      Withdrawals

14.1.1.  According to the provisions of GEO 34/2014, you have the right to withdraw from the Contract between the Parties within a maximum of 14 days from the date of delivery of the Products and/or Services.

14.1.2.  In accordance with Article 16(D) of Government Emergency Ordinance No. 34/2014, ornamental plants are products that are likely to deteriorate or expire rapidly and are exempt from the right of withdrawal.

14. 1.3.  In order to exercise your right to withdraw from the Contract (in the case of non-perishable and non-personalized Products), you must inform us of your decision to withdraw by means of a clear statement, providing us with your name and the details of the order you wish to cancel. You do not need to give a reason for your decision to withdraw.

14.1.4.  To notify us of your decision, please contact us by email or customer support phone within 14 calendar days of the delivery date.

14.1.5.  If you decide to withdraw from the Contract, you must return the Products concerned within 14 days of the date of notification of your withdrawal. If the Products are returned by courier, you will bear the cost of the return.

14.1.6.  If you choose to withdraw in accordance with the above, FUNDAȚIA BAZA GHILGAL will refund the full amount of your Order without undue delay, but in any case no later than 14 calendar days from the date of communication of your decision to withdraw.

14.1.7.  For refunds, the GHILGAL FOUNDATION will use the same payment methods as those used by you for the initial transaction.

 

14.2.      Cancellations

14.2.1.  If for any reason you wish to change or cancel your order, please contact us using the contact information provided above.  

14.2.2.  If your cancellation request is made before the date and time specified for delivery, FUNDAȚIA BAZA GHILGAL will refund the full value of the Order. 

14.2.3.  If delivery cannot be made on the date and/or time slot specified in the Order, you have the following options:  

–        cancellation of the order and full refund or

–        rearranging the delivery to another date/time slot, at our expense. 

14.2.4.  Also, if the Products suffer major damage during delivery, you can ask us to cancel the Order or redeliver the Products ordered in optimal conditions. 

14.2.5.  If your cancellation request is due to an error not attributable to the Seller or occurs after the specified delivery period, we will refund the order value, minus delivery costs.

 

15. 15. WARRANTY

15.1.      General

15.1.1.  The products sold by FUNDAȚIA BAZA GHILGAL are covered by a warranty in accordance with the legislation in force (Government Ordinance No. 21/1992, Law No. 449/2003, Government Ordinance No. 174/2008).

15.1.2.  Details about the characteristics of each product are provided on the Website.

15.1.3.  Information regarding warranty terms and conditions and general instructions for use of various types of Products may be provided/made available upon delivery or may be requested by email.

15.1.4.  The BAZA GHILGAL FOUNDATION will validate your warranty claim only if the returned Product is intact and accompanied by proof of purchase.

15.1.5.  The Product may be returned to the headquarters of FUNDAȚIA BAZA GHILGAL Florists or by courier to any of the locations mentioned in the Contact section.

15.1.6.  The warranty shall not apply to Products that show signs of impact, cracks, or scratches.

 

15.2.      Non-perishable products

15.2.1.  Products that are not susceptible to rapid deterioration benefit from a legal guarantee of conformity in accordance with the provisions of Law 449/2003 on the sale of products and associated guarantees, republished.

15.2.2.  Activation of the above-mentioned warranty entails the replacement or reimbursement of the value of non-perishable Products that prove to be non-compliant/defective, about which the Customer notifies us in writing.  

15.2.3.  This latter notification must be sent to us within the legal deadline and must address the occurrence of a situation of non-conformity/defect in the Products that has arisen within a maximum of 2 years from the date of delivery.  

15.2.4.  Your warranty claims will be resolved within 15 calendar days of notification.   

 

16. 16. DISPUTE RESOLUTION

16.1.      In all cases, the Seller and the Buyer shall attempt to resolve amicably any dispute, controversy, or claim arising out of or in connection with the Contract and/or these Terms and Conditions, including with respect to their validity, interpretation, performance, or termination.

16. 16. 17. PARTNERS

17.1.      The Seller may assign and/or subcontract a third party for services related to fulfilling the order without informing the Buyer, as the Buyer’s consent is not required.

17.2.      However, the Seller shall always be liable to the Customer for all obligations assumed under the Contract and through these Terms and Conditions.

 

18. 18. FORCE MAJEURE

 18.1.      Neither Party shall be liable for the non-performance/improper performance of its obligations if such non-performance/improper performance is the result of Force Majeure or Fortuitous Event.

18.2.      Force majeure refers to any external, unforeseeable, absolutely insurmountable, and unavoidable event.

18.3.      A fortuitous event is understood to be any event that cannot be foreseen or prevented by the person who would have been liable if the event had not occurred.

18.4.      If, according to the law, a Contracting Party is exempt from liability for the occurrence of a fortuitous event, it is also exempt in the event of force majeure.

18. 18. 19. SOCIAL NETWORKS / SOCIAL MEDIA

19.1.      We appreciate your feedback on our Products and/or Services, whether you use our Platform and/or our social media pages.

19.2.      Please note that the provisions of this Document also apply when you use any of our websites or social media pages.

19.3.      If you contact us with a complaint, an authorized member of our online team will endeavor to respond and resolve your complaint in a timely manner, in accordance with the FUNDAȚIA BAZA GHILGAL customer service policy.
